Under Texas Penal Code § 47.01 & 47.02, a gambling device is defined as one that awards prizes determined in whole or in part by chance. C-Store Amusements, LLC’s machines do not meet this definition. Our games:

In April 2025, the Texas Sixth Court of Appeals issued a major ruling in State of Texas v. 5 Gambling Machines affirming that skill-based devices—like those used by C-Store Amusements, LLC are not gambling devices under Texas law. The court found:

  • A skillful player can win back 100% of entry costs

  • No element of chance determines whether a prize is awarded

  • Devices with these characteristics are legal and protected under Texas Penal Code § 47.01 & 47.02​

 

This ruling provides judicial precedent that directly supports our business model and legal compliance.
